RENTAL POLICIES
CAR RENTAL POLICIES (the “Rental Agreement, Policies or Contract”). Lessor, following called SnapCarz, rents cars to Renters in agreement to all terms and conditions listed below.
1. GENERAL RENTAL REQUIREMENTS
1. GENERAL RENTAL REQUIREMENTS
THESE ARE THE GENERAL RENTAL REQUIREMENTS OF SNAPCARZ CAR RENTAL.
A. Rental Rates: Daily Rental rates are based on a 24 hour “rental day” starting at the time of rental. The minimum charge is one day, plus mileage, if applicable.The renter will be charged for each hour and/or any part of an hour in excess of a rental day the renter keeps the vehicle, until the vehicle is returned, up to the applicable daily rate. Mileage charges, if applicable, will be the number of miles driven as determined by the odometer readings at the beginning and end of the rental The Rental Rate is subject to increase if you return car more than 24 hours before or 24 hours after the scheduled Return Time. Late returns beyond 30 minute grace period may be subject to extra hour and/or extra day charges, in addition to any other rental charges. If the renter fails to comply with the conditions applicable to the rate, including any geographic driving restrictions, a mileage charge, surcharge or other rates may apply. Each vehicle has an allowance for 150 miles per day ie. (3 day rental the renter would be allowed to drive 450 total for the whole rental) If miles are surpassed the allotted miles there will an extra charge of $1.25 per miles. This applies to all vehicle classes.
B. Driving Age: The minimum age to rent a vehicle is 21 years of age.
C. Authorized Drivers:The SnapCarz vehicle may be driven only by an authorized driver. An authorized driver is the renter and any additional person who appears at the time of rental, and signs the rental agreement. All authorized drivers must satisfy our age requirements, have a valid driver’s license, provide a physical street resident address, a major credit card in their own name, and fulfill our other qualifications. The authorized driver and any additional authorized drivers may be subject to a driver record check (see below). No other persons are authorized to drive the vehicle.
D. Additional Authorized Drivers and Fees:
All additional authorized drivers are required to qualify to drive the vehicle. To qualify, SnapCarz requires all additional drivers, including spouses, to satisfy our minimum age requirements, and have a valid driver’s license.
The additional driver may also be subject to a driver record check and an underage driver’s fee. (See below).
E. Underage Driver’s Fee:
: An authorized driver that is 21 years of age will be charged an Underage Drivers fee because of such driver’s age. A renter that below 25 years old is going to be charged an Underage Drivers fee as well. Fee subject to vehicle and location.
F. Credit Qualifcations/Requirements: To qualify to rent a SnapCarz vehicle, the renter must have a valid credit at time of booking and start of reservation matching the renters own name with available credit and funds. At the time of rental, an authorized hold will be secured on your credit card provided to cover the estimated rental charges plus an additional $200.00 for credit cards to cover additional charges that may be incurred. Unless, renters that are picking up the same state as their drivers license the authorized hold will be $500.00. These funds will not be available for your use until the end of the rental after charges apply.
G. Gasoline Policy:
The renter must refill the gas tank of the vehicle within a 10-mile radius of the rental return facility and present a fuel receipt to avoid a refueling charge unless the renter chooses the prepaid fuel option. If the renter chooses the prepaid fuel option, the renter will pay a specified charge as set forth in the rental agreement and have no obligation to return the vehicle with a full tank of fuel. The fuel charge is based on each 1/8 of gallons needed for the car. Below is the rate for how is each 1/8 of the tank charged per car class:
Compact, intermediate, full-size, full-size hybrid, Compact SUV, Open Air 3 Wheeler: $20.99 per 1/8 of gallon
Midsize- SUV, SUV hybrid, Full-size Recreational Vehicle, Premium Sports Car, Fullsize Open Air All Terrain, Minivan, Luxury Sedan, Standard Convertible: $25.99 per 1/8 of gallon
Fullsize SUV, Standard Elite SUV, Premium SUV, Standard Pickup Regular Cab, Luxury Elite Special, Luxury Convertible: $35.99 per 1/8 of gallon
H. Geographic Limitations:
Driving is restricted to the continental United States and is NOT ALLOWED TO BE DRIVEN TO ANY OTHER COUNTRY.
I. Driver Licenses:
United States Citizens and U.S. Military Personnel: A renter or any additional authorized driver who is a citizen of the United States, upload a photo at the time of rental:
(1) A driver’s license issued by any state, territory or possession of the United States, and valid for the entire rental period
(2) A temporary driver’s license, valid for the entire rental period
(3) A traffic citation issued as a temporary license, valid for the entire rental period (the court date being the expiration date) and a second form of identification with signature (excluding the credit card used for rental),
(4) A valid U.S. military identification card plus an expired driver’s license for active duty U.S. military personnel in those states where active duty U.S. military can drive on an expired driver’s license.
(5) A valid driver’s license issued by a province or territory of Canada
(6) A mobile or digital driver’s license does is not allowed and SnapCarz will only accept hard copy driver licenses.
(7) A foreign driver’s license* issued by the country of residence of the renter and additional drivers. If the driver’s license in not in English, the renter and drivers will be required to present both the foreign issued driver’s license and a current International Driver’s Permit (“IDP”); or, if from Japan, a Japanese Translation Service. An IDP does not give a person the right to drive, but provides a certified translation of the valid foreign driver’s license. An IDP can be obtained in the driver’s country of residence only with a valid driver’s license. An IDP (or certified translation) without the foreign issued driver’s license is not acceptable.
*If the foreign issued driver’s license is from a country where “permanent” or “non-expiring” driver’s licenses are issued, the renter and any additional drivers will also be required to show their passport, visa or other current U.S. issued documentation at the beginning of the rental authorizing the renter or driver to be present in the USA at the time of rental.
J. One-way Rentals:
One-way rentals are not allowed on SnapCarz. If the renter does not return the vehicle to the location stated on contract unless authorized by a SnapCarz representative, the renter is responsible for all costs for vehicle to be returned to the proper location.
K. Contactless Requirements and Regulations:
SnapCarz process requires contactless pick/drop-off procedure. The renter is the only person that is allowed to pick the rental, if rule is not followed, SnapCarz has the authority to report activity to local law enforcement and consider the vehicle as “stolen”. The renter would lose all future rental privileges and may receive penalty charges. SnapCarz has the right to refuse to release vehicle to renter if renter does not follow check in procedure. In each SnapCarz vehicle, there would be a lockbox where keys, keycard, and information sheet would be stored the renter is responsible to return those items back into lockbox upon returning the vehicle to avoid any penalties. Renters are responsible to read instructions provided by SnapCarz on how to use lockboxes/keycard.
L. Cancellation Policy
Guest may cancel free of charge up to 24 hours before the renters trip starts. Guest who book within 24 hours of their trip start have one after booking to cancel for free. All renters that cancel within 24 hours of start will be charged the whole entire rental amount. If Snapcarz cancels due to unavailability or maintenance issues, the renter will receive a full refund.
M. Additional Fees:
At SnapCarz locations, the renter may incur one or more of the following charges and fees: (i) an (airport) concession recovery fee or off-airport access fee; (ii) an (airport) consolidated facility charge; and vehicle license fees which are the estimated average per day per vehicle portion of our total annual vehicle taxes, licensing, titling, and registration costs, and other governmental fees or charges on top of the daily rate and any optional products and services the renter selects. These charges are calculated either as a per day or a per rental charge.
- Change Fees: Any changes to the reservation within 12 hrs of pick up will be charged a change fee. Fees will depend on location, time, and demand.
- Late Return Fee: In addition to being charged additional days/hours, SnapCarz has the right to charge a $50 per day fee to compensate costs that incur in finding an alternative vehicle for the next guest. Please let us know by calling our customer service number to extend or modify your reservation.
Energy Surcharge – To offset utility charges, software usage, and parking fees SnapCarz will imposing an Energy Surcharge to cover costs.
Lockbox fee: If renter damages/loses lockbox or keycard during the rental period they are responsible for the following charges:
Lockbox replacement fee: $100
Keycard replacement fee: $125
Rock chips on windshield (we document pictures of the windshiled before and after the rental if there are any rock chips); $50 per chip.
N. Lost and Found: SnapCarz will not be responsibility for any personal belongings left in the vehicle or within the location premises.
O. Tickets and Tolls:
SnapCarz has the legal right to provide drivers information to law enforcement and toll agencies for proper liability.
P. Trackers:
Each SnapCarz vehicle will be equipped with a Global Positioning Tracker that would be embedded into the vehicle, or plugged into an OBD-II port. Renters are NOT ALLOWED to remove any trackers. If renter tampers or destroy trackers, renters will be responsible for damages and fines.
Q. Smoking and Cleaning:
There is no smoking, any tobacco or tobacco-related products, marijuana or marijuana substitutes, e-cigarettes, or personal vaporizers allowed in any of SnapCarz vehicles. If found, the renter will be charged a fee of $450 to remove the smell. If renter leaves the following they will be charged a $250 cleaning fee:
- Biowaste or bodily fluids
- Spills or waste that requires cleaning inside of vents or between the door panel and window
- Major stains or residue that covers a large area of the vehicle’s interior and would require steam cleaning or a full detail
- An extreme amount of caked on mud, dirt, sand, or insects that requires professional-level exterior detailing
- Significant amounts of pet hair
Vehicles need to be returned at the time stated in the contract. If vehicle is not returned at that time and there has been no communication through phone, text or email, the vehicle can be picked up by SnapCarz after 4 hours. Additional Usage will be added to the contract. Personal items in the vehicle will be returned when the outstanding bill is settled and the keys have been returned.
If there has been communication between SnapCarz and the renter, then the contract will be updated and payment must be paid in order for the renter to continue using the vehicle. If no agreement can be reached then SnapCarz reserves the right to pick up the car or call the police to facilitate return of the car as the car will be considered stolen at this point.
Any costs associated with the repossession of the vehicle will be the renters responsibility.
2. Electric Vehicle Policies
These Electric Vehicle Rental Terms (“Rental Terms”) are between The SnapCarz, LLC and its affiliates (“SnapCarz” or “us”) and You and apply to a rental of an electric vehicle from SnapCarz. An EV is defined
as a vehicle that exclusively uses battery power rather than gasoline or diesel fuel. These Electric Vehicle Rental Terms are in addition to the Terms and Conditions of the Rental Agreement applicable to your rental.
A. EV Charge Level At Pick-up and Return:
SnapCarz will endeavor to provide the EV at time of vehicle pick-up with a battery charge of 80%. You are required to return the EV with a minimum charge within 5% of what it was picked up at unless prepaid recharging was purchased. You are responsible to maintain a sufficient charge on the EV during your rental. You will be responsible for the cost of any tow if the EV is not drivable due to a low battery. You are not authorized to call a private tow on SnapCarz’s behalf.
All tows of the EV must be by flatbed and must be arranged through SnapCarz Emergency Roadside Assistance. If the EV is overdue for return SnapCarz may remotely disable and recover the EV.
B. Range:
Range is the estimated distance an EV can travel on a single charge. The EV information provided with your reservation that describes a range is not guaranteed. The battery life of the EV is impacted by a number of factors including weather, driving and road conditions. It is your responsibility to ensure the EV has sufficient remaining battery life to return the EV to SnapCarz or reach an EV charging station.
C. Charging During Rental: Subject to Tesla’s terms and conditions, Tesla EV’s are able to access Tesla Superchargers to recharge the EV. If You use a Tesla Supercharger to recharge the EV during your rental, that cost will be billed back to SnapCarz and added to your rental charges. These charges may not appear on the final invoice and may be added later due to processing time. Battery charging limit on a Tesla should be set at 90% maximum. You may recharge the EV at other public or private charging locations at your own cost. You may also have to register and incur a fee at certain of these locations. You are responsible for any registration (including accepting terms and conditions and privacy policy) and any fees. If you do not move the EV promptly from the charging stall when it is finished charging. You may incur an Idle fee for the time the EV remains in a charging stall after it is finished charging. You are responsible for and will indemnify SnapCarz for any Idle or similar fee incurred when the EV is on rent to you. If the EV is overdue for return SnapCarz reserves the right to remotely disable and remove the EV from the charging platform.
D. Charge Purchase Option/EV Battery Recharge Fee/Undercharge Battery Fee:
With the purchase of the optional Charge Purchase Option (CPO) for a fee of $35.00 at the time of rental, You can return the EV at any charge level above 20%. If You do not elect to purchase the optional CPO and You return the EV with a charge level less than 70% You will be assessed an EV Battery Recharge fee of $35.00 unless the charge level at time of rental was less than 75%. If You return the EV with a charge level less than 20%an Undercharge Battery fee of $25.00 will apply in addition to any applicable EV Battery Recharge fee.
E. Damage To Charging Stations:
You are responsible for any damage to the EV, the charging station equipment or the charging location when charging the EV during your rental. You will indemnify SnapCarz for any charges, fines, or penalties You incur for any damage or loss to the EV, the charging station or location during your rental.
F. Equipment:
The EV will be provided to you with certain equipment for which You are responsible. You are responsible to notify SnapCarz if any of the following equipment is not with the EV at the time of pick up. Otherwise, you will be charged for any missing equipment at return. Loss Damage Waiver (LDW) does not apply to damage or loss of the equipment provided with the EV.
G. Key Card/Fob:
You are responsible to return the Key card or Key fob upon your rental return. If the Key card or fob is damaged or lost, You will be charged to replace the Key Card or fob and a service fee. The Key card or Key fob must only be used to charge the EV You have rented. Sharing the Key card or Key fob, using additional Key cards or Key fobs to charge the EV, or charging other vehicles is prohibited. Any misuse of the Key card or Key fob in breach of these Rental Terms will result in additional usage charges.
H. Tesla Charging Kit:
The Tesla Charging Kit consists of 1 Mobile Connector; 1 Storage Bag; and 1 NEMA 5-15 Adapter. You are responsible to return all contents of the Charging Kit upon your rental return. If the Charging Kit, or any part of the contents are damaged or lost, You will be charged for a complete Charging Kit, as these items are not available to be replaced individually, and a service fee.
I. J1772 Adapter:
You are responsible to return the J1772 Adapter on your rental return. If this Adapter is damaged or lost, You will be charged to replace the Adapter and a service fee.
J. Software Updates:
The EV may contain onboard computers which periodically suggest software updates. You are not authorized to update the in-vehicle software at any time unless specifically requested to do so by a SnapCarz representative. If a software update prompt is received during your rental, please ignore this or press cancel. If You do update the software (other than following the explicit instruction of a SnapCarz representative) this is at your own risk and SnapCarz accepts no responsibility or liability whatsoever including, but not limited to, any loss of use, interruption of service, incompatibility with training materials or otherwise.
K. Dash Cam and Personal Data:
The EV may be equipped with a Dash Cam which may record incidents involving the EV during your rental and may be used by SnapCarz. You are responsible at return to delete all personal data input by You or collected by the EV during your rental. Please note, the EV may still retain recordings if the EV is involved in an accident.
3. Liability, Insurance, and Optional Protection Package
A. Loss or Damage to SnapCarz vehicle:
The renter and any additional drivers are liable for any loss or damage to the rental vehicle, even if someone else caused it or natural disaster. Once we release the vehicle to you, you are 100% responsible You are responsible for the damages including:
- Actual towing and storage charges;
- Loss of use;
- Diminution in value, regardless of whether the vehicle is repaired or not;
- All rental charges through the date you report the incident if not returnable or the return date, whichever is later;
- Any out-of-pocket expenses incurred by us as a result of the loss or damage to the vehicle;
- A reasonable administrative fee; and
- Pro-rata license plate fees, all as allowed by law.
- If vehicle is involved in total loss, you are responsible for the full value of the vehicle.
SNAPCARZ WILL DOCUMENT PREEXISTING DAMAGES ON EVERY VEHCILE BEFORE RELEASING IT TO RENTER. IT IS RENTER’S RESPONSBILITY TO TAKE THEIR OWN DOCUMENTATING ON PREEXISTING DAMAGE AT START OF RENTAL.
B. Third Part Liability Claims:
Unless otherwise required by applicable law, a renter and/or any additional authorized driver (and the respective insurance company of each) is primarily responsible for all third party claims of personal injury, including death, and property damage caused or arising from the use and operation of the SnapCarz vehicle during the rental. You agree to indemnify and hold SnapCarz harmless from and against, and will defend SnapCarz against all loss, liability or damages whatsoever arising out of the use or operation of the vehicle during the rental, plus costs and attorneys’ fees. (To the extent SnapCarz is required to provide coverage, in spite of the terms of the rental agreement, it shall only be in an amount necessary to satisfy the minimum financial responsibility limits required by applicable law.)
C. Optional Protection Package:
At the time of rental, SnapCarz offers for purchase at the option of the renter, Loss Damage Waiver (“LDW), and Liability Insurance Supplement (“LIS”). The cost, coverage, provider and availability vary by location, vehicle category and rate. The optional products offered by the rental company may duplicate coverage provided by the renter’s personal automobile insurance or insurance the renter may have through another source. Purchase of optional products is not required to rent the vehicle. We charge a per day fee for each day, or part of a day, the vehicle is rented for any optional products you select.
D. Personal Insurance Eligibility
All renters that are
using personal insurance policies are required to provide FULL COVERAGE
insurance that covers rental vehicles. Renters also needs provide proof of insurance ie. Declaration
page or insurance by uploading them to the reservation. If renter does not
provide proof of insurance, they are required to purchase Loss Damage Waiver
(“LDW”) and Liability Insurance Supplement (“LIS”).
E. Loss Damage Waiver (“LDW”)
LDW, or loss damage
waiver, is an optional product that releases you from financial liability for
any loss or damage to the rented vehicle, providing you have not broken any of
the terms and conditions of the rental agreement. If the renter purchases LDW,
SnapCarz will agree to waive the renter’s responsibility for loss or damage to
the vehicle in full LDW. It is not insurance or an insurance product. This LDW
Coverage only covers up to $45,000 of value of the vehicle.
LDW does not apply if:
(1) the renter uses the vehicle in violation of the rental agreement (i.e.
Letting an unauthorized driver to operate the operate, etc.); (2) the renter
fails to remove the keys, or close and lock all windows, doors and trunk, and
the vehicle is stolen or vandalized; (3) the renter fails to notify us and the
police immediately after the loss; and (4) the renter fails to pay the charges
under the rental agreement; or (5) other exceptions as allowed by the
applicable state or provincial law.
The purchase of LDW is not mandatory. LDW is not insurance.
F. Liability Insurance Supplement (“LIS”):
SnapCarz LIS is secondary coverage which provides you liability protection, damage claims made against you by people injured in an accident involving the SnapCarz vehicle. If claims are made above the listed amounts, the renter would be liable for the remaining amount.
